Item 6.1 Amendments to Ticket Information Utilization Bylaw

Constitutionally, the municipal institutional authority to
regulate the private use of land is a provincial power under the
"property and civil rights" heading in Section 92(13) of the
Constitution Act, 1867. Accordingly, the laws controlling land use
are primarily provincial, although there are exceptions created by
federal control over lands used for Indian reserves, airports,
railways, harbours and other purposes regulated by federal law. |

Government bound by enactments; exception
14 (1) Unless it specifically provides otherwise, an enactment
is binding on the government.
(2) Despite subsection (1), an enactment that would bind or
affect the government in the use or development of land, or in
the planning, construction, alteration, servicing, maintenance
or use of improvements, as defined in the Assessment Act, does
not bind or affect the government. |

Uppal be renewed for an additional three years to permit up to 14 (fourteen)

• The housing structures shall be two Atco Trailers, which are sited as per the

6. COMMUNITY SERVICES
6.1 Regional Floodplain Management Plan Update - Presentation by
Hugh Hamilton, Associated Environmental Consultants Inc.
Staff report dated May 31, 2016 outlined that Phase 1 of the
Regional Floodplain Management Plan had been awarded to Associated
Environmental. Hugh Hamilton was on hand to address the work
completed to date. Phase 1 has set the regional framework for the
identification of flood risk, including identifying flood hazards,
assessing the likelihood of flooding, and identifying potential
consequences. Priority areas have been identified that may warrant
further review and floodplain mapping in subsequent phases.
Highlights of Phase 1 plan was noted. The next step is to gain
feedback in order to complete the draft Phase 1 plan, and then move
to Phase 2 and Phase 3. The floodplain management framework was
highlighted.
What's next: is there funding for Phase 2 and Phase 3? Staff noted
that Phase 2 portion has not been awarded. The Phase 1 report will
be published as soon as it's finalized. The consultants were looking
for feedback from the committee and then will finalize the report.
It will be circulated to the Board, and posted on the RDCO website
once completed.

Staff report dated May 24, 2016 outlined the referral application for the
exclusion of lands from the Agricultural Land Reserve.
Sam Samaddar, City of Kelowna Airport Director, outlined the application
including the vision for buildings and uses required for future growth of the
airport and economic indicators.
Agency referral comments were reviewed.

question what a stage 3 septic system is. It is the highest level septic system.

Introduction
Similar to 2014, this year was filled with activities as wide-ranging as a major
fundraising event, attendance at the RDCO's Kokanee Festival, grant writing, and
site tours for prospective projects. The combined result of this work is a
regional land trust with a strengthened financial position, stronger connections
to the community, and a rising awareness of the value of COLT to funding
opportunities that are not open to local government. The following headings
identify some of the work undertaken on behalf of improvement to local
biodiversity and the ultimate benefit of us all.
1. Financial
The financial dimensions of COLT's work this year were largely in two areas,
both of which
help us meet our mandate, support our partner local governments, and strengthen
regional biodiversity. First, our grant writing work has secured roughly
$600,000 of funding and other support toward projects we have in partnership
with either the Regional District Central Okanagan and the City of Kelowna.
Second, in addition to the Hobson Family Fund announcement of their second
installment of $25,000, and the 25th Anniversary event provided us with an
opportunity to announce two other funding contributions. First, Cynthia Hunter,
one of the original signators to the COLT's incorporation as a registered
society, came forward with an endowment in the amount of $20,000 registered with
the Central Okanagan Foundation. This brings COLT's endowed funds to more than
$200,000. Second, Todd Cashin, with the group Trout Unlimited, announced a $5000
challenge donation to the Mission Creek Restoration Initiative - the challenge
went out to the OCEOLA Fish and Game Club, Peachland Sportsman's Association,
and the Kelowna Fish and Game Club - one of those challenges has already been
met in the amount of $5000.

To protect and maintain access to an area known as the 'Bouldering Fields' by
improving road access, expanding the current parking, installing pit toilets and

Executive Summary:
The proponent, Okanagan Bouldering Society, is working in partnership with
Recreation Sites and Trails BC (RSTBC) to formalize and manage the area's
existing use. The subject Crown lands are currently used from April to November
for parking, camping, bouldering, festivals and other recreational activities.
RECOMMENDATION:
THAT FrontCounter referral application for the purpose of improving the existing
access road and drainage, increasing the parking lot capacity, and providing a
designated camping area under the Forest & Range Practices Act located south of
the City of Kelowna in the vicinity of Myra-Bellevue Provincial Park, Gillard
Creek and Bellevue Creek (CL-15-11) for the Okanagan Bouldering Society be
conditionally supported subject to the following being addressed prior to
issuance of, or applied as conditions, to any land tenure approval:
• An environmental impact assessment be undertaken and a management plan
developed.
• Ensuring that the proposed use can co-exist with other existing uses in the
area.
• In addition to signage, consideration of installing barriers to restrict
motorized access beyond the parking area.
• The applicant to meet with RDCO Planning staff to discuss the zoning for the
proposed campsites.
• Clarify whether other tenures or proposed tenures overlap.
• Issues and recommendations noted by the Environmental Advisory Commission and

SUBJECT: Floodplain Exemption (Application FEX-15-01)

Purpose:
To exempt the subject property from Section 3.28 Floodplain Regulations of
Zoning Bylaw No. 871 by allowing a reduction of the minimum setback from
Okanagan Lake from 15.0 metres (49.2 ft.) to 10.0 metres (32.8 ft.).
Executive Summary:
The subject parcel is very unique and geographically challenged as it is
bisected by Westside Road and Westside Place; the remainder of the parcel
located above Westside Road is very steep. The owner intends to demolish the
cabin currently located on the property and is requesting approval for the
location to construct a home. The Regional District has received a report
completed by a Qualified Professional (QP) indicating that the land may be used
safely
for the use intended.
RECOMMENDATION:
THAT the Board approve Floodplain Exemption application FEX-15-01 subject to the
following condition:
• Registration of a Floodplain Covenant under Section 219 of the Land Title Act
to the satisfaction of Regional District staff which restricts construction
within the Floodplain Setback as required by RDCO Zoning Bylaw No. 871, s.3.28,
to the floodplain setback referenced in the February 23, 2015, Floodplain
Assessment Report by Peter Hanenburg, Professional Engineer, Interior Testing

challenging for redevelopment. The owner intends to demolish the cabin currently
located on the property and is requesting approval for the location to construct
a home. The requested setback variances are to ensure that the proposed house is
located as far from the foreshore as possible. The
required permit to reduce building setback has been obtained from the Ministry
of Transportation and Infrastructure. The Development Variance Application is
being submitted for consideration concurrent with Floodplain Exemption
Application FEX-15-01.
RECOMMENDATION:
THAT Development Variance Permit Application VP-15-02 to vary the following
Zoning Bylaw No. 871 regulations to permit the siting of a proposed single

5.1 FrontCounter BC Referral Application to formalize
Okanagan Bouldering Society (applicant) existing use, and to protect and
maintain access to an area known as the "Bouldering Fields' south of the City of
Kelowna adjacent to Myra-Bellevue Provincial Park (CL-15-11) Central Okanagan
East Electoral Area (All Directors - Unweighted Vote)
Staff report dated January 18, 2016 outlined the
FrontCounter BC referral application for Okanagan Bouldering Society. The
Society is working with Recreation Sites and Trails BC to formalize and manage
the areas existing use.
The subject Crown land is currently used from April to November for parking,
camping, bouldering, festivals, etc. Staff reviewed the application's intent to
formalize and manage the area's existing use. The Society will be responsible
for
management of the site.
Staff highlighted RDCO and agency referral comments. Discussion included:
- As there is not an existing campground approved, will zoning need to be
changed? Staff noted it will depend upon the type of camping. Currently some
camping occurs in the parking area. The camp site will be co-managed between the
two organizations. How many campsites are planned? This information is not
available, but staff has asked for information regarding the proposed campsite.
- Why is an environmental impact study being requested? The RDCO Environmental
Advisory Commission recommended a study to ensure the environment is considered
and protected when developing access to the site, and campgrounds.
- Who maintains the access road to the site? Current access is from the KVR
forest service road. Access from the KVR road to the site is maintained by the
Society.
- Sports like this encourage healthy access to the backcountry.
- The site has been utilized by Kelowna Fire Rescue for training activities.
- What is meant by 'festivals'? It is hoped it will only be a bouldering
festival not a 'music' festival.
- FrontCounter BC makes the final decision on all recommendations.

THAT FrontCounter referral application for the purpose of improving the existing
access road and drainage, increasing the parking lot capacity, and providing a
designated camping area under the Forest & Range Practices Act located south of
the
City of Kelowna in the vicinity of Myra-Bellevue Provincial Park, Gillard Creek
and Bellevue Creek (CL-15-11) for the Okanagan Bouldering Society be
conditionally supported subject to the following being addressed prior to
issuance of, or applied as conditions, to any land tenure approval:
• An environmental impact assessment be undertaken and a management plan
developed.
• Ensuring that the proposed use can co-exist with other existing uses in the
area.
• In addition to signage, consideration of installing barriers to restrict
motorized access beyond the parking area.
• The applicant to meet with RDCO Planning staff to discuss the zoning for the
proposed campsites.
• Clarify whether other tenures or proposed tenures overlap.
• Issues and recommendations noted by the Environmental Advisory Commission and
City of Kelowna staff.

floodplain setback provisions of Zoning Bylaw No. 871 to permit the siting of a
proposed single detached house adjacent to Westside Place and Okanagan
Lake (FEX-15-01) Central Okanagan West Electoral Area (Electoral Areas, West
Kelowna & Kelowna Fringe Areas - Unweighted Vote)
Staff report dated January 18, 2016 outlined the floodplain
exemption application.
The Subject property is unique and geographically challenged as it is bisected
by Westside Road and Westside Place. The remainder of the parcel located above
Westside Road is very steep. The owner intends to demolish the cabin currently
located on the property and requests approval to construct a home. A Qualified
Professional report indicating the land may be used safely has been received. An
environmental permit application and development variance have also been
submitted to the RDCO for approval. Staff believes the application meets
provincial guidelines for consideration of a floodplain exemption. A covenant
stating the conditions for exemption will be placed on the title of the affected
property.
No comments have been received by the public subject to posting notification.
Riparian component is being addressed through the environmental development
permit. With respect to the sewage system-type 3 onsite sewerage dispersal
system will be required to be approved through Interior Health. Qualified
professional states this is a much improved development from what is currently
on the site.
The applicant, Kevin Orriss, addressed the Board.
• Property was originally purchased in 1986.
• The family is sensitive to environmental issues surrounding the lake
• He has worked with Ecoscape Environmental on the plan, and have added
vegetation to what is currently there.
• The septic system (a stage 3 system) is the best that can be done onsite.

single family detached house. The requested setback variances are to ensure that
the
proposed house is located as far from the foreshore as possible. The required
permit to reduce the building setbacks has been obtained from the Ministry of
Transportation and Infrastructure. Agency referral comments were outlined.
There has been no correspondence received regarding this proposal.

Purpose:
The purpose of this report is to seek Regional Board approval to renew the
foreshore licence of occupation for Bertram Creek, Gellatly Nut Farm, and
Kalamoir Regional Parks and Lakeshore Road Community Park for a term of 30
years.
Executive Summary:
The Province of British Columbia is in the process of renewing the foreshore
licence of occupation for Bertram Creek, Gellatly Nut Farm, and Kalamoir
Regional Parks and Lakeshore Road Community Park, licence 341938. Instead of the
standard 10 year renewal the Province is offering a 30 year renewal licence and
requires a resolution of support from the Regional Board. The foreshore licence
of occupation for these parks is required to operate the swim areas along the
foreshore of the parks and for placing swim protection measures such as swim
buoys within the swim area. In anticipation that several other existing RDCO
park foreshore licences of occupation will be offered for either a 10 or 30 year
term, staff have recommended that the RDCO Board support all future licence
renewals for any similarly offered extended terms.
RECOMMENDATION:
THAT the Regional Board approves the renewal of Licence of Occupation # 341938
for a 30 Year Licence of Occupation from the Province of BC for Lakeshore Road
Community Park, Bertram Creek, Gellatly Nut Farm, and Kalamoir Regional Parks.
AND FURTHER THAT the Regional Board approves the renewal of
any existing Licence of Occupation tenures for park purposes for either a 10
year or 30 year term as nominated by the Province of BC.

Staff report dated January 6, 2016 outlined the Licence of
Occupation renewals for Lakeshore Road Community Park, Bertram Creek and
Gellatly Nut Farm and Kalamoir Regional Parks.
It was noted that in anticipation of other existing RDCO
park foreshore licence renewals for either 10 or 30 year terms, Board support is
sought for any similarly offered extended terms. Provincial staff have suggested
that Board approval be
sought for all renewals that are coming up (19 Crown tenures) for example, 8 are
due in 2016-2017, and 3 in 2017-2018. Staff outlined the various parks in Crown
tenure. Staff noted that a stand-alone report will be brought forward for
Mission
Creek Regional Park as discussions continue with Westbank First Nation on
renewal of a Licence of Occupation.
It was noted that the Kalamoir Park tenure does not run the
full length of the park but is divided into three pockets along the foreshore of
the park. The question was raised whether the RDCO could seek tenure for the
full length of the Crown
land foreshore? Staff noted that the key swim areas are protected through a
foreshore license with the federal government. The RDCO has limited management
authority on the foreshore.

THAT the Regional Board approves the renewal of Licence of Occupation #341938
for a 30-year Licence of Occupation from the Province of BC for Lakeshore Road
Community Park, and Bertram Creek, Gellatly Nut Farm and Kalamoir Regional

Executive Summary:
Two dwellings exist on the subject property; however, under current zoning one
single detached house is permitted. The proponent has substantiated historic use
of the site, and the application is similar to other approved site-specific
bylaws approved by the Board. The landowners have agreed to register a covenant
on title to restrict building size and replace the two existing septic systems
to meet IHA requirements. To date, no opposition has been received from affected
agencies or neighbouring property owners regarding the application.
RECOMMENDATION:
THAT the Regional Board receives for their information the report of November
16, 2015, from the Manager of Planning regarding Zoning Amendment Bylaw No.

FrontCounter BC Referral Application
The Regional Board has given conditional approval to an application made to
FrontCounter BC from the owners of the La Casa development strata. The Strata
Corporation has applied to purchase three tenured parcels of Crown land
totalling 3.28-hectares in order to protect existing land uses and on one parcel
to construct amenities for the strata owners at the resort. The Board support is
conditional on the applicant addressing a number of conditions prior to
completion of the sale including amendments to the strata bylaws to reflect ‘no
motorized vehicle’ areas and installation of a fence along the property boundary
to prevent off-road vehicle access in the environmentally sensitive Fintry
Provincial Park and Protected Area.
July – September Program & Service Update
The Regional Board has received an update on program and service accomplishments
during the third quarter of the year. These include receipt of a Small
Communities Fund grant of $1.9-million for upgrades to the Killiney Beach water
system; the creation of two new composting instructional videos by the Regional
Waste Reduction Office; two national awards for the Economic Development
Commission; a clean GST audit report and the start of preparations for the 2016
budget process. Potential deficits have been identified and staff is working to
mitigate in the areas of Electoral Area Planning, Economic Development and the
Dietrich/Trepanier water system.
The Regional District provided staff
along with other local government partners during three activations of the
Emergency Operations Centre for the Joe Rich/Huckleberry fire, the Bear Creek
fire and the Shelter Cove/Westside Road wildfire. After nine
months, the Dog Control service has 20,700 licensed dogs (19,815 from Jan. -
Sept. 2014). In Planning, Service Agreements for Fringe Area Planning have been
endorsed between the Regional District and four member municipalities. In Parks
Services, three draft management plans are being developed; a new Cottonwoods
pedestrian bridge has been installed over Mission Creek and a community
consultation survey was conducted on possible infrastructure upgrades for the
Fintry Community Park – Lake Access #3.

The applicant proposes to purchase three parcels of Crown land
currently under tenure. La Casa development users have
historically been accessing the adjacent Fintry Provincial Park
and Protected Area with ATVs. As of summer 2015, the Strata
Council has worked collaboratively with BC Parks to address ATV
access concerns with a focus on stewardship of the adjacent
environmentally friendly lands.
RECOMMENDATION:
THAT FrontCounter referral application to permit the purchase of
three Crown land parcels adjacent to the La Casa resort
development, south of Fintry (CL-15-1 0) for the Owners of
Strata Plan KAS2428 (La Casa) be conditionally supported subject
to the following being addressed prior to the issuance of, or

have been replaced (ie: completed Record of Sewerage System and
a completed Sewerage System Letter of Certification as accepted
by Interior Health).

Purpose: To provide the Board with third quarter year-to-date
information pertaining to the 2015 work plan and budget variance
report.
Executive Summary:
We are pleased to present the 3rd Quarter Work Plan and Budget
Variance Report to September 30th, 2015. You will notice a new
graphic system in this report that uses traffic light icons to
indicate the work plan / budget variance status for each service
provided by the RDCO:
Red Light
- indicates work plan and/or budget targets not met
Yellow
Light - indicates potential or minor variances expected
Green Light
- indicates work plan and budget targets are tracking well and
are expected to be met
As of September 30th all work plans and
service revenues / expenses are within anticipated budget

7.1 Report regarding a FrontCounter BC referral application
to purchase three parcels of Crown land currently under tenure in the vicinity
of La Casa Lakeside Cottage Resort (CL-15-1 0) Central Okanagan West Electoral
Area (All Directors - Unweighted Vote)
Staff report dated November 16, 2015 outlined the
FrontCounter BC referral application to permit the purchase of three parcels of
Crown land currently under tenure. La Casa Resort Development users have
historically been accessing the
adjacent Fintry Provincial Park and Protected Area with ATVs. The strata council
has worked collaboratively with BC Parks to address ATV access concerns with a
focus on stewardship of the adjacent environmentally friendly lands.
The three Crown land parcels are approximately 8 acres in
size. The survey plan was highlighted. It was noted that the management plan
appended to the Board report is not the most current report La Casa has
developed (a new one has just
recently been drafted which illustrates how the lands will be managed in such a
manner consistent with limiting environmental impacts to the neighbouring
protected area).
Staff provided an overview of the site including the upper
and lower loop roads including signage placed prohibiting motorized vehicle
access.
BC Parks letter of support was noted. In addition, Westbank First Nation has
consented to the sale of the lands.
Mr. Curtis Darmohray of Pushor Mitchell, lawyer for the applicant, asked through
staff to address the Board regarding the recommended condition for consolidation
of the parcels with Strata KAS2428.

THAT Mr. Darmohray be invited to address the Board.

Mr. Darmohray addressed the Board
- A request to remove from the staff recommendation that
the parcels be consolidated. Consolidating these three parcels would require
unanimous approval by the 501 strata owners which would be difficult as many of
the owners do not live in the area-owners are from all over Canada, as well as
outside Canada. The question was asked if there isn't a more practical way to
address this issue.
- The Strata Council proposes that a covenant be registered on title that the
Crown parcels cannot be sold.
Staff noted consolidation would be a better approach as
registering a covenant may create difficulty down the road for development on
the property (ie: buildings encroaching the property boundary) and as long as
the newly created lot is 1 ha
minimum in keeping with the C5 zone of Zoning Bylaw No. 871. Technical issue of
registering the covenant can be addressed at rezoning.
- Mr. Darmohray noted the Strata Corporation would own the three parcels and the
covenant would be binding on the Strata Corporation. The roadway will provide
direct access to the common property of the Strata therefore the parcels will
always be required and would never be sold. All green space lots are owned by
the Strata Corporation. Green space lots cannot be combined as unanimous
approval would be required for this as well.
Director Hanson arrived at 8:10 p.m.

Regional District Rejects Developer Allegations
The Regional District of Central Okanagan has received
notice of another court action brought against it by
Kelowna Mountain.
The Regional District rejects all claims made against it
and will vigorously defend itself at the appropriate
time in court should this case proceed.
Two previous attempts by Kelowna Mountain Development
Services Ltd. to challenge the planning authority of the
Regional District have been rejected by the courts. The
most recent failed bid was in September 2014 when the
Court of Appeal dismissed the case, upholding the
validity of the RDCO Zoning Bylaw No. 871.
RDCO Board Chair Gail Given says, “It’s unfortunate that
yet again, Central Okanagan taxpayers will be footing
the bill for a legal challenge from this developer. I
can say that the Regional District will actively defend
itself against these unproven and false accusations that
are without merit. I can also confirm the Regional
District has yet to receive any application from the
developer for consideration by the Regional District.
Any further comments will be respectfully reserved for
court.”

Purpose:
To consider a Front Counter BC referral application pertaining
to the disposition of Crown land for the purpose of transferring
the land as an addition to the
Westbank Indian Reserve
for an indefinite term.
Executive Summary:
The Crown lands proposed for disposition are associated with a
negotiated land el<change between Westbank First Nation and the
Ministry of Transportation and Infrastructure for lands required
for a highway Improvement project. Several issues and concerns
have been identified, including RDCO Parks Services having
ongoing interests in the area and the District of Peachland
being opposed to the proposal.
RECOMMENDATION:
THAT Front Counter referral application for the purpose of
withdrawing Crown land from disposition for the purpose of
transferring the land as an addition to the Westbank Indian
Reserve (indefinite term) under the Land Act in vicinity of
Highway 97C, adjacent to Trepanier Road (CL-15-09) for Ministry

Purchase
Purpose:
To consider a FrontCounter BC referral application to permit the
purchase of three Crown land parcels (Term: indefinite).
Executive Summary:
The applicant proposes to purchase three parcels of Crown land
currently under tenure. The purchase of the Crown land parcels
is of great concern to a number of agencies and RDCO staff as La
Casa development users have been accessing the adjacent Fintry
Provincial Park and Protected Area with ATVs; La Casa has not
proven stewardship of the adjacent environmentally sensitive
lands.
RECOMMENDATION:
THAT FrontCounter referral application to permit the purchase of
three Crown land parcels (Blocks B, C & D) adjacent to the
La Casa resort
development, south of Fintry (CL-15-10) for the
Owners of Strata Plan KAS2428 (La Casa) not be supported.

6.1 Report regarding a FrontCounter BC referral
application to withdraw Crown land from disposition for the purpose of
transferring the land as an addition to the Westbank Indian Reserve in the
vicinity of Highway 97C, adjacent to Trepanier Road. (CL-15-09) Central Okanagan
West Electoral Area (All Directors - Unweighted Vote)
Staff report dated October 19, 2015 outlined the referral
application for the disposition of six Crown land parcels for the purpose of
transferring the land as an addition to Westbank Indian Reserve for an
indefinite term. The disposition is associated with a negotiated land exchange
between Westbank First Nation (WFN) and the Ministry of Transportation and
Infrastructure for lands required for a highway improvement project.
The parcels are located within the Trepanier area of Central Okanagan West
Electoral Area, approximately 92~ acres of land. Staff reviewed an overhead of
the subject property. There is no information available as to what the future
land use is being proposed by WFN.
Staff noted the District of Peachland has provided a letter
of opposition to the application listing issues such as: property is located in
their watershed, Trepanier Road is not designed for large volumes of traffic
which may become an issue in the future should gravel production begin within
the site, property should be included in the West Kelowna Fire Protection
contract with WFN and that the property will not conflict with the proposed Hwy
97 bypass in this area.
Staff report outlined various agency comments including
Parks Services comments regarding RDCO's ongoing interests in the area for
recreational trail connection opportunities. Historically, FrontCounter does
take the conditions provided by RDCO into consideration.
The Board was reminded that RDCO does not have any decision
making authority and that FrontCounter has indicated their desire to move
forward with a decision shortly. It was noted that addition to reserves takes a
long time and can be a frustrating process for the applicant. Often lands are
not contiguous to current First Nation lands. It was further noted that WFN
could purchase any Crown land and local governments would have no opportunity
for comment.
Councillor Werstuik addressed comments raised at the Board
table. Westbank First Nation live in the area and water is critical to their
people as it is with others, provincial legislation applies to forestry work,
environmental protection is critical to their people-laws of general application
apply, their laws meet or exceed provincial standards, the gravel pit has not
been in operation for years, as good neighbours would not do something
contradictory to local areas, road right-of-way is not included or subject to
the agreement. WFN has fulfilled their obligations in respect to the highway
upgrades and believes the land falls within their aboriginal lands and title.
The question was raised if Trepanier residents have been
asked to comment. It was noted that community meetings are not normally held for
a provincial referral application such as this.

• There is existing zoning for the ski hill. The ski lift operation is
provincial jurisdiction.
• There is no harm in leaving the application for one final year. The onus is on
the owner to get all outstanding conditions completed over the year.

5.2 Information Report: FrontCounter BC Referral
Applications - Ministry of Forests, Lands and Natural Resource Operations
The Regional Board at its June 11, 2015 meeting
expressed concern that FrontCounter BC's current referral process does not
provide the Regional District with a list of agencies that have been notified.
A request was forwarded to FrontCounter that the RDCO be provided with a list of
agencies that are being consulted on all future referral applications.
FrontCounter BC responded to the Regional District's concern in its letter of

Providing a list of all agencies and stakeholders receiving a referral on every
Crown land application would create an administrative burden for the Province,
but also raises privacy concerns for some stakeholders. FrontCounter is prepared
to meet with staff on issues of concern.

Planning
5.1 Extension Request for Zoning Amendment Bylaw No.
871-177 for Crystal Ski and Golf Resort Inc. (owner) and Pheidias Development
Management Corporation (agent) to add the Crystal Mountain Comprehensive
Development Zone into Zoning Bylaw No. 871, and to zone the subject Phase 1
lands accordingly. Located adjacent to Glenrosa Road and Last Mountain Road
(Z08/03) Central Okanagan West Electoral Area (All Directors - Unweighted Vote)
Staff report dated September 2, 2015 outlined that another
extension has been requested for Crystal Ski and Golf Resort Inc. as the
financing required to proceed with the project has not yet been secured. Second
and third readings were given in 2009 and there has been no activity with the
file nor has it been demonstrated that the project will proceed since that time.
There is concern that over the years the zoning amendment has been extended,
agency requirements may have changed. Staff believes it would be prudent for the
developer to come forward with a new application, if and when they are able to
proceed with the project.
The owner has recently indicated their intent to replace
and upgrade the ski-lift infrastructure on Crystal Mountain. Completion of the
work is not possible for this season but anticipated, if funding can be put in
place, to be completed by
the 2016/17 season. It was noted that the zoning amendment does not limit the
developer from completing upgrades to the ski hill--the Master Agreement for the
resort is with the Province.
The Board was reminded to restrict their comments to the
extension request as no new information can be received by the Board for the
zoning amendment bylaw. It was noted that the owner, Mr. David Tschanz is in
attendance.
In discussion it was noted:
• Agency requirements since 2009 may have changed or may be invalid.
• The key agency is the City of West Kelowna. There are servicing agreements
with West Kelowna which may no longer be valid.
• With provincial agencies, comments are normally valid for one year.
• Why not complete the rezoning application, what is the hold-up? The rezoning
does not impact the ski hill development.
• Staff noted they believe there were 14 conditions at third reading that had to
be satisfied before adoption of the bylaw-most but not all have been completed.
• If an extension is denied will it impact the reopening of the ski hill in
2016/2017? The comprehensive development master agreement with Province stays in
place.
• If the extension is denied, staff will meet with the applicant when they are
ready to move forward with Phase 1 development and the process would start
again.
• Want to see economic development in the area but there have been so many
extensions with no assurance the project will proceed.
• The 'global' financial situation is unlikely to change 'overnight'.
• The applicant has the ability to continue with the ski hill replacement - a
functioning ski hill would attract investors if there is an interest.
Mr. David Tschanz addressed the Board highlighting that
plans are underway to upgrade the ski hill lift and gondola with plans to reopen
in 2016/2017. Over $5mil has been invested to date but he is still looking for
investment funds. It has been difficult to raise funds in Europe for ski
resorts. He is negotiating the purchase of high-end ski equipment in Europe and
is convinced he can raise $45mil to complete the project and build a high
quality resort.
The Board, through a staff interpreter speaking German,
asked him the following:
If he is committed to see this through, Why not complete the rezoning
application now and then find the investors for upgrades to the ski hill. He
stated he is not prepared to spend any more dollars unless he has funding
commitment for the full project, which for him includes the ski hill. He stated
that investors will not come forward if they are not assured that zoning is in
place.
Staff noted there may be some confusion with the owner (due
to the language barrier and that his agent was not in attendance) for the
requirements of the rezoning application and the ski hill development. Servicing
agreements can be addressed through the subdivision development bylaw. Staff is
able to work with the applicant on the issue of rebuilding the ski hill.
Anything outside ski hill structure rebuilding would require the rezoning to be
approved.

THAT the Regional Board deny a request for a one-year extension to Crystal Ski &
Golf Resort Inc. (application Z08/03).

EXAMPLE OF HOW RDCO ENFORCES
ITS ZONING BYLAW #871

RDCO Building Dept told us twice that this
property does not have a building permit.
RDCO Bylaw Enforcement won't tell us anything, so we are going
through Freedom of Information to find out why there is a Travel
Trailer and Vehicle on an empty lot without a dwelling unit and
without a building permit, as well as being an outdoor storage yard
without a dwelling unit or building permit. On the August long
weekend they were post pounding, chain sawing, and running a
generator for hours a day. If it wasn't for the generator
noise running in the evening, we probably wouldn't have made a
complaint, but when you are trying to water your garden in the
evening, and you have to listen to a generator running in the
evenings for a few weeks, it finally encouraged us to make a
complaint. Then they brought a machine in, and
moved a bunch of dirt, filling in voids. Don't know if the
property owner knows you can't build a foundation on fill without
putting in piles. All that noise pretty much ruined our August long
weekend. We reported this before the
August long weekend after the property owner had stayed in two
travel trailers and had been there a couple weeks running his
generator, and it looked like
they were moving in. When we talked to the property owner, we
asked if they were going to build, and we were told hopefully.
Then we asked, by winter, and we were told again, hopefully.
If they are going to build, shouldn't they have a building permit? It took RDCO
a couple weeks before they attended, which was after we told RDCO
there was a machine in there. That green thing is a water slide.
The pickup has been parked there for a few weeks. There is a
large wire cage looking thing sitting there and a bunch of tires,
and now a white tarp tent has been erected. This looks like a
storage yard to us, does it to you? This photo was taken Sept
6, 2015. And apparently there is a
property on Hodges Road in Killiney Beach that has been building without a building
permit too, which our Director is trying to deal with.

3.13 Prohibited Uses
1. The following uses are prohibited on parcels that do not contain
a dwelling unit, and are located in R or R3 zones:
a) Outdoor storage yard.
b) The parking of recreational or other vehicles.

LACK OF
ACCOUNTABILITY

Now here is one problem with the Regional District of Central
Okanagan Bylaws.
Notice how close the fence is to the 10 foot wide Easement Road?
There is no bylaw against
building your fence right alongside an easement road that is only 10
feet wide on a hill and runs for quite a ways, maybe 200 feet or
more. The RDCO tell us that this is a civil matter for the
courts to deal with. The property on the right owns the easement road and
uses the easement road along with several other properties further
down (before the photo). The property with the fence has never
once in over 10 years plowed the easement road, in fact one time the
easement road was even blocked with a pile of snow and a cement
block hiding under the snow and the property claimed it was for
their kids. The property on the left has no use to this
easement road other than to visit a neighbor. The easement
does not belong and is not intended to be used by the property on
the left. Why should all the snow be piled on the left when it
is the property on the right who owns the easement road? The
property on the right is pretty much telling us how much they don't
like us to use the easement road in our opinion. There should
be some bylaw that requires a fence setback to allow for snow
accumulation. This fence is ridiculous, but like the property
owner on the right said, they are allowed!!! Would be nice if
the property on the right would leave some place to put the snow!
And it would be nice if the Regional District would put something
about this in their bylaw so that some people can't bully the
neighbors by using extraordinary measures when one neighbor doesn't
like the other neighbors to use their own easement road! This
easement road is listed on several properties land title documents
that they have use of this easement road to pass and repass.
One time the property on the right also blocked the easement road
and the one neighbor paid to have some work done enough to satisfy
the property on the right to unblock the easement road, we were told
after we found our address sign at our gate instead of on a tree at
the end of the easement road at the top of the hill near the paved
public road. Our address sign was on the left of the easement
on the tree originally, but the one neighbor who paid for the work
took that tree out to satisfy the neighbor on the right who blocked
the easement road, and he left our address sign that was on the tree
at our gate, and so we put our address sign on a post we put up on
the left of the easement road, but then someone kept knocking the
post over and then one day we found the licence plate that belonged
to the property on the right wrapped around our address sign post.
The RCMP told us that wasn't enough evidence to convict someone.
One time we found machine tire marks driven at our post, and our
post knocked over again, and the neighbor on the right had just
rented a machine with the same tire tread. Another time
another neighbor was out for a walk and found our address sign in
the ditch all bent up, and brought it to us asking if this was our
address sign. Then our nice metal address sign disappeared
completely and we put up a chloroplast sign as shown in the photo,
but our post still kept getting knocked over. Our post is still
there now but the chloroplast on one side disappeared and we
couldn't find it anywhere around there so we think the neighbor once
again vandalized our address sign. Now we are just leaving our
address sign like it is, cause the neighbor on the right is such a
you know what!!! So anyway this is the story, its just too bad
that people can get away with bullying like they do, and we have
authorities who either can do nothing about it, or will do nothing
about it!!!

Should the subdivision process be successful, the newly created

Staff report dated August 17, 2015 outlined the requirement
for renewal of a temporary use permit for a 3-year period to allow a medical
marihuana production facility. A renewal permit is requested in order to
accommodate Health Canada inspection and licensing of the facility, and to
complete the associated lot consolidation/boundary adjustment with the two
adjoining parcels.
Lot consolidation is 'on hold' until the Health Canada inspection is completed.
An overview of the current building on the site and requirement for lot
consolidation was highlighted. A variance will be required for the existing
building as it tranverses only slightly into the 30-meter setback requirement.
Once approved the facility will comply with minimum lot size requirement of the
RDCO zoning bylaw.
It was noted that the District of Peachland was not consulted on the renewal
application. Staff noted that renewal of permits such as this are not referred
to the municipalities. This application does not relate to 'fringe area
planning' as all
municipalities are now part of electoral area planning. Electoral Area planning
decisions are made at the Board table, not at Council tables.
Staff further noted that if Health Canada approved the facility 'tomorrow'
renewal of the permit would not be required. The same conditions as the original
permit apply to the renewal.
OPHUS/FINDLATER
THAT the decision to renew the Temporary Use Permit (Application TUP-14-01) for
C. Stowell be POSTPONED until the District of Peachland Council has been
consulted on the permit renewal application.

Purpose:
To amend the boundaries of three service areas and one specified
area in the Central
Okanagan East Electoral Area.
Executive Summary:
The service areas and specified area are located in the
community of Ellison, directly east of and abutting, the
boundary of the City of Kelowna. The mapping revisions are
minor, three areas on the map are pre-empted by City of Kelowna
boundary expansions and a fourth by an in-fill subdivision that
was bisected by a service area boundary line.
The four amendment bylaws will not affect or change the purpose,

Purpose:
To obtain Agricultural Land Commission (ALC) approval to allow
the landowner to subdivide a 0.4 ha (1 acre) lot from the 6.2 ha
(15.27 acre) subject parcel.
Executive Summary:
While not meeting all provisions of the ALC's Homesite Severance
on ALR Lands Policy No. 11 (Policy), the owner purchased the
property in the 1960's and has farmed the parcel for over 50
years. During this time, the owner has lived on and off of the
property. With implementation of conditions and restrictions on
the proposed subdivision, impacts on the remaining farm parcel
and neighbouring farm operations should be negligible.
RECOMMENDATION:
THAT Agricultural Land Commission application A-15-02 (M.
Melnichuk - owner/R. Holtby agent) to allow subdivision of a 0.4
ha (1 acre) lot from the 6.2 ha (15.27 acres) parcel is
supported subject to:
> Registration of restrictive covenant(s) on the proposed
remainder parcel to not allow additional residences and to limit

Purpose:
To allow a reduction of the minimum side setback to permit the
siting of an existing accessory building and a single family
dwelling.
Executive Summary:
At time of the purchasing the property in 2014, the owner
commenced working with Regional District staff to bring all
non-conforming structures into compliance with RDCO bylaws. A
Survey Certificate confirms that two existing buildings do not
conform with the side yard setback of the Joe Rich Rural Land
Use Bylaw No. 1195. No objections have been received from
neighbours, agencies or from RDCO staff regarding the
application.
RECOMMENDATION:
THAT Development Variance Permit Application VP-14-03 to vary
Section 2, Part 5.6.6 of Joe Rich Rural Land Use Bylaw No. 1195
by allowing a reduction of the minimum side yard setback from
8.0 m (26.2 ft.) to 4.54 m (14.90 ft.) to permit the existing
accessory building, and from 8.0 m (26.2 ft.) to 5.38 m (17.65
ft.) to permit the existing single family dwelling be approved.

Purpose:

Executive Summary:
All technical requirements associated with the secondary suite
will be addressed in conjunction with the zoning amendment and
Building Permit process, To date, no opposition has been
received from affected agencies or neighbouring property owners
regarding the application.

Staff report dated July 20. 2015 outlined the application for subdivision. The
landowner is requesting support from the Regional District to treat the
subdivision request under the ALC's Policy as the owner intends to retire on the
0.4 ha lot and sell the remainder of the parcel. Staff outlined the history of
the property which was purchased by the family in 1962.
The application does not meet the ALC's policy of a homesite severance as the
owner has not continuously lived on the property since purchasing it in 1972.
The owner occupied the property from 1968 to 1979 and then again from 1995 to
the present time. The application generally meets the intent and spirit of the
ALC's Homesite Severance Policy. The family continues to actively farm the
land.
Staff reviewed the property and the proposed area for the homesite severance.
Photos of the property were highlighted. With the conditions outlined in the
recommendation to the Commission staff believe it meets the intent of the
policy.

6.3 Part 26 Cost Sharing Agreements 2016 (All Directors -
Unweighted Vote)
Staff report dated July 6, 2015 outlined the background for
full participation in the fringe area planning function approved in 2015. The
statutory deadline for a municipality to provide Notice if it wishes to withdraw
from electoral area planning is August 31 st in a given year that would go into
effect on January 1st.
In March 2015, the municipalities of Kelowna, District of
West Kelowna, Peachland and lake Country opted in to full participation of
fringe area planning.
Since that time the municipalities have considered options
for continuing with participation. Staff are requesting direction to negotiate a
new Part 26 Cost Sharing Agreement for the future.
OPHUS/BASRAN
THAT the Regional Board authorize the Chief Administrative Officer to enter
negotiations with the cities of Kelowna & West Kelowna, and the Districts of
Peachland and lake Country for a new Part 26 Cost Sharing Agreement in

Staff report dated July 9, 2015 outlined the 10 Year
License of Occupation for regional park purposes of Rose Valley Regional Park.
The current term is due to expire April 2016. The Regional District has received
a Modification Agreement from the Province to amend the current tenure area to
exclude 0.4599 hectares from the Northwest corner of District Lot. 4183. Knights
Gate Properties Ltd. applied to the Province for a Section 80 Roadway over the
District Lot.
The Regional Board previously adopted a resolution at its
September 25, 2013 (#186/13) meeting of non-support issuance of a Section 80
Roadway but supported the issuance of a temporary use permit to provide personal
and private access to the existing Lot 4, District Lot 3871 through Rose Valley
Regional Park.

THAT the Regional Board approves the completion of a Province of BC Modification
Agreement dated May 27,2015 to amend the Licence of Occupation, Licence Number

park purposes. This addition will strengthen partnerships,
enhance public recreational amenities, establish ecosystem and
trail connectivity between parks, and protect sensitive ecosystems and valuable' habitat for species at risk.
The proposal is in keeping with the RDCO South Slopes Official
Community Plan Bylaw No. 1304 (OCP), Regional Growth Strategy
Bylaw No. 1336, and Strategic Plan: Vision 2020.
RECOMMENDATION: THAT Ministry of Environment (BC Parks) referral application for
the purpose of adding 264 ha Crown land to Okanagan Mountain

Staff report dated June 3, 2015 outlined the referral
application from the Ministry of Environment (BC Parks) requesting approval to
permanently add 264 ha (652.4 acres) of Crown land to Okanagan Mountain

Westbank First Nation (WFN). It is important to the Board that WFN be consulted

Purpose: To amend the Permitted Uses Table for the RU2 Rural 2 zone,
Section 6.2.1 by adding a new subsection 6.2.1.18 - On Lot 1,
Plan 12705, District Lot 2198, ODYD the following additional use
is permitted: 2 dwelling units.
Executive Summary: Two seasonal dwellings exist on the subject property; however,
under current zoning one single detached house is permitted. The
proponent has substantiated historic use of the site, and the
application is similar to other approved site-specific bylaws.
In January 2015, the Regional Board considered Bylaw No. 871-226
and referred the application back to staff. Subsequently, the
landowners have amended the application, agreed to register a
covenant on title, and submitted a preliminary sewage dispersal
assessment based on seasonal use.
RECOMMENDATION: THAT Zoning Amendment Bylaw No. 871-226 be given first reading; AND THAT the scheduling of application Z14/06 for a Public
Hearing be withheld pending: • The applicant submitting an updated sewage dispersal
assessment from a Qualified Professional basing recommendations
on zoning which permits two dwelling units occupied year-round. • Interior Health reviewing the updated preliminary sewage
dispersal assessment and providing updated comments. • The applicant submitting a draft covenant restricting the

Agricultural Land Reserve Appeal
5.2 Application to exclude land from the ALR for Tolko
Industries Ltd. (owner), Kent Macpherson (agent) located adjacent to Westside
Road (A-15-01) Central Okanagan West Electoral Area (All Directors - Unweighted
Vote)
Staff report dated May 19, 2015 outlined the application to
obtain Agricultural Land Commission approval to allow the 1.07 ha Agricultural
Land Reserve (ALR) portion of the 7.7 ha property to be excluded from the ALR.
The property is owned by Tolko Industries It has not been used for agricultural
purposes in the past. It has previously been used by the Ministry of
Transportation and Infrastructure for a graving dock staging area to construct
components of the William R. Bridge. The current landowner has no immediate
plans for the property and will consider potential future options that reflect
the best use of the land.
STACK/BASRAN
THAT the Regional Board supports application A-15-01 for Tolko Industries Ltd
(owner) for exclusion of a portion of the subject property, Lot B, Plan 31195,
District Lot 539, ODYD, from the Agricultural Land Reserve pursuance to Section

Board Meeting
Support for Crown Land Disposition The Regional Board conditionally supports a referral application made to
FrontCounter BC by the Ministry of Transportation and Infrastructure. The
Ministry wants approval to transfer approximately
272-hectares of Crown land to the
Westbank First Nation in recognition of an exchange of a portion
of Reserve lands for a highway improvement project. The portion of Crown land
affected is between and connects the existing Indian Reserves #11 and #12, south
of Mission Creek. The Board support for the application is subject to an update
being made to the Master Agreement (July 2000) between the Westbank First
Nation, Regional District, City of Kelowna, Black Mountain Irrigation District
and South East Kelowna Irrigation District to recognize and address each
agencies interests associated with the Crown land transfer.
Proposed Communication Tower The Regional Board has no objections to a proposal by Rogers Communications to
install a new communication tower on privately owned land in the 5800 block,
Chute Lake Road. As proposed by the company, the 50-meter tall structure
conforms to the requirements of Zoning Bylaw No. 871 and will provide improved
coverage and network quality in the upper Mission area.

disposition of Crown land for the purpose of transferring the land as an

Executive Summary: The proponents, Ministry of Transportation and Infrastructure, outline that this
land transfer is in recognition of an exchange of Crown land for a portion of
Indian Reserve lands for a highway improvement project. While no objections have
been received by the Regional District, staff notes that comments received
include interest to extend the Mission Creek Greenway through the subject lands;
maintain McCulloch Road access to lands beyond; consider the area's
environmental values; and receive further consultation if future development is
proposed.
RECOMMENDATION: THAT Front Counter referral application for the purpose of Withdrawing Crown
land from disposition for the purpose of transferring the land as an addition to
the Westbank Indian Reserve (indefinite term) under the Land Act in vicinity of

Purpose: To consider a request for concurrence of the Rogers Communications Inc. proposal
to install a telecommunications tower on privately owned land.
Executive Summary: The proponent, Rogers Communications Inc. c/o Cypress Land Services, proposes to
install a 50-metre-tall telecommunication tower. Zoning Bylaw No. 871 permits
the proposed use in all zones. Approval for proposed telecommunication sites on
privately owned land is governed and processed by Industry Canada on behalf of
the Government of Canada. In accordance with Industry Canada's Default Public
Consultation Process (DPCP), the proponent requires a Regional Board resolution
indicating land-use authority approval.
RECOMMENDATION: THAT the Regional Board advise Rogers Communications Inc. that it is satisfied
with the public consultation process related to their proposal to install a
50-metre-tall telecommunications tower at 5819 Chute Lake Road. AND THAT the Regional District of Central Okanagan confirms that the proposed
wireless telecommunications facility on the subject property conforms with RDCO
Zoning Bylaw No. 871 and therefore have no objections provided it is constructed
substantially in accordance with the plans submitted to the Regional District of
Central Okanagan.

Staff report dated May 6, 2015
outlined the referral application from FrontCounter BC
pertaining to the disposition of Crown land for the purpose
of transferring the land as an addition to the Westbank
Indian Reserve for an indefinite term. The land transfer is
in recognition of an exchange of Crown land for a portion of
Indian Reserve lands for a highway improvement project.
No objections were received from agency referrals/technical
comments however the RDCO has interests (ie: environmental
mapping resources, park services interests) that will be
provided to FrontCounterBC. It is not known what the
future land use will be.
The question was raised whether this
referral application is part of the exchange for the Highway
97 land exchange required for the highway upgrade. It was
confirmed that the lands in question are associated with the
land exchange required for the highway upgrade.

5.2 Request for a Proposed Rogers
Communication Tower on Privately Owned Land in the Vicinity
of Chute Lake Road - Central Okanagan East Electoral Area
(All Directors - Unweighted Vote)
Staff report dated May 6, 2015
outlined the request of Rogers Communications Inc. proposal
to install a telecommunication tower on privately owned
land. The request is for concurrence to install the tower
and recognize the Industry Canada public consultation that
occurred. This is the first type of application the RDCO has
been asked to confirm its installation.
It was noted that for our residents living in a rural area
increased service will be appreciated.
Public consultation is as per
Industry Canada requirements which was a 150m distance
required. Notice was placed in the Daily Courier, and staff
at the City of Kelowna was contacted for comment.

adjustment), the owners will be required to satisfy all
technical requirements of local and provincial governments.

Planning
5.1 Referral Application - Ministry of Forests, Lands and
Natural Resource Operations - Westbank First Nation (applicant) Ministry File:
34114455 (All Directors - Unweighted Vote)
Staff report dated march 26, 2015 outlined a referral
application from the Ministry of Forests, Lands and Natural Resource Operations
(MFLNRO) for Westbank First Nation (applicant). The proposed head lease areas
are encapsulated by lands with the District of West Kelowna. The head lease
areas are deemed to have no impact to any of the Regional District's
infrastructure or land use bylaws.
The applicant, Westbank First Nation (WFN), has made application for two
separate head leases. The head lease areas extend into Okanagan lake by 300
meters. If approved by the Province, the lease will require WFN to observe,
abide by and comply with all applicable laws of any government authority having
jurisdiction in any way affecting the use or occupation of the foreshore area or
improvements located on the foreshore. Other than the map provided by MFLNRO no
additional information was provided to the Regional District.
It was noted that the District of West Kelowna has endorsed
the referral from MFLNRO. They note it is good for WFN to have control over
their foreshore.
FINDLATER/CARSON THAT the Regional Board advise the Ministry of Forests, Lands and Natural
Resource Operations (MFLNRO) that the interests of the Regional District of
Central Okanagan are unaffected with respect to issuing a head lease to Westbank
First Nation under the Land Act on Okanagan lake foreshore adjacent to 1.R.#9
and 1.R.#10; AND FURTHER THAT the Community Services department report dated march 26, 2015
be forwarded to the MFLNRO office for their information and consideration.

Purpose: To discharge Land Use Contract No. 199 from the subject properties and designate
the parcels as Rural Acreage (RA) and Small Holdings 2 (SH-2).
Executive Summary: There are five parcels currently regulated under LUC No. 199. The owners of two
of the lots are requesting approval to discharge the LUC to permit a boundary
adjustment intended to increase the agricultural capability of the farming
operation on the proposed 12.11 ha parcel. At time of subdivision, the owners
will be required to satisfy all technical requirements of local and provincial
governments.
RECOMMENDATION: THAT the Regional Board receives for their information the report of March 16,
2015, from the Manager of Planning regarding Land Use Contract Amendment Bylaw
No. 199-03 and Joe Rich Rural Land Use Amendment Bylaw No. 1195-11.

Staff report dated March 16, 2016 outlined the discharge of
Land Use Contract No. 199 from the subject properties and designate the parcels

Staff report dated March 16, 2015 outlined a development
variance permit application to allow a reduction of the front setback to permit
the siting of a proposed detached garage. The sUbject property was noted on the
overhead.
There have been no objections received to date. Staff noted
that the area for the detached garage should not have been cleared until
approval was received but noted that the applicant was unaware of this and is
working with staff to address issues.
Chair Given asked if there was anyone in the gallery who
deemed their property to be affected by the application.
R. Reiger - President of A. R. Castle Home Design &
Contracting Ltd. representing the applicant addressed the Board noting that the
environmental study which had been completed gave permission to clear the trees,
they inadvertently cleared more than what should have been. It was not
intentionally done. The request being made is quite minor.
Staff noted that the Ministry of Transportation and
Infrastructure has issued a permit to reduce the building setback to allow the
detached accessory building.
STACK/DONN THAT Development Variance Permit Application VP-15-01 for B. & C. Boyle (owners)
to vary Section 6.5.4 of Zoning Bylaw No. 871 by allowing a reduction of the

legally designate Crown land for a recreation trail or site (term indefinite) in
the vicinity of Gillard Creek (CL-15-03) Central Okanagan East Electoral Area

Staff report dated March 16, 2015 outlined the referral
application from FrontCounter BC to construct, rehabilitate and/or maintain
recreation mountain bike trails by the Mountain Bikers of the Central Okanagan.
The recreation trails are intended as intermediate and advanced single-track
mountain bike trails that consist of man-made and natural technical features.
These trails represent a well-used and popular trail system
that has been utilized for over a decade.
The RDCO previously supported a similar application
approximately five years ago but did not proceed due to unresolved technical
isssues. FrontCounter has confirmed the current application is similar to the
previous one in geographic location and proposed designation under the Act.
The trail system is located in a popular recreation area in
the South Slopes. A small portion of the trail system extends into the Okanagan-Similkameen.
It is not known if RDOS has been provided with a referral. This would come from
FrontCounter BC. It is unknown if the trails are open to the public.
A letter of support was received from the City of Kelowna.
As well, City of Kelowna had submitted a letter of support to the Province in
late 2014.
OPHUS/HODGE THAT the applicant be invited to address the Board regarding their application.

Justin Derbyshire - president of the Mountain Bikers of the
Central Okanagan (MBCO) and Central Okanagan Trail Alliance addressed the Board
highlighting: - There has been some interference with motorized recreation users and mountain
bikers. This is not a sole source agreement, it is an agreement to develop the
trails. In the future they would like to move to only non-motorized usage. - The MBCO cannot limit use of the trails. The area is open to the public as it
is Crown lands. Mountain bike specific trails are being developed. In the future
may develop trails that are multi-use aspect (non-motorized recreation). - Outlined the clean-up work the biking community has done (an area known as 5K
in the south slopes) and will continue with these efforts as stewards of the
land. - The Board thanked the members on the work they have done in the area.

6.1 Okanagan Regional Library Population Numbers For Electoral Area Levy
SUBJECT: Population Numbers Used by Okanagan Regional
Library for Electoral Area Levy
Purpose: To provide the Board with background information
with regard to the 27.255% increase in Electoral Area population counts used in
Okanagan Regional Library's (ORL) levy calculation which resulted in a large
increase to the levy. Staff from the ORL will be at the March 12th G&S meeting
to answer any questions the Board may have. It is hoped ORL will agree to
further review the numbers.
Executive Summary: The ORL allocates its levy to participants over four regional districts based
50% on population and 50% on assessments. In 2015, the increase in the population counts used for RDCO's Electoral Areas (EAs)
varies disproportionately from all other participants across the four regional
districts. The average population increase for all participants was 1.98%, or
7,013 (see Table 2). The RDCO's electoral area population increase was 27.255% -
from 5,742 to 7,307, a difference of 1,565 people (and is much higher than
Kelowna's increase of 3.633%, which seems unlikely). BCAA growth rates indicate
1.12 - 2.88% in the EA's. This has resulted in a large levy increase from $291,262 in 2014 to $327,748 in
2015. Of the total increase of $36,486, $30,431 relates to the apportionment
formula which uses population and assessments, and $6,056 relates to a budget
increase.
Population numbers have fluctuated widely over the years, and as a result, it
appears the EA's have likely been paying more than their share of the ORL Levy.
The RDCO disputed these figures in prior years, and it appeared the issue was
resolved in 2014, albeit not retroactively. Surprisingly, in 2015, the population numbers rose again, along with the levy.
RECOMMENDATION: THAT the Board request that the ORL review the population numbers now, and for
future calculations.
Table 1 below shows the widely fluctuating population
numbers used to calculate the funding levy to RDCO for the Electoral Areas in
the past. The corresponding tax levies are also shown. This has caused huge annual tax fluctuations to rural home owners from year to
year, as the service area is small. For example, the increase in taxes to the
average home in Central Okanagan East 2015 is $11.49, and in Central Okanagan
West $6.67.

6.2 Technical Rescue Service Proposal District Of West Kelowna
SUBJECT: Technical Rescue Service Proposal- District of
West Kelowna
Purpose: To present a Technical Rescue Service Proposal
from the District of West Kelowna.
Executive Summary: On April 28th, 2014 the Board approved the following resolution:
"THAT the Regional Board authorize Brian
Reardon, CAO, to enter negotiations with the District of West Kelowna for the
provision of Non-Core Regional Rescue Services on the west side of the W. R.
Bennett Bridge."
Since that time the District of West Kelowna has trained
and equipped its fire department to respond to and provide technical rescue
services within its boundaries. Negotiations for the provision of Non-Core
Regional Rescue Services in Peachland, on Westbank First Nation Lands and in
Central Okanagan West has been ongoing and has recently been completed as
evidenced in the letter from the District of West Kelowna's CAO dated February
25th, 2015.
There are numerous benefits to having a fully trained and
operational regional rescue team on the west side of Okanagan Lake including
faster response times, greater capacity to respond to major events, and avoiding
potential traffic delays on the J.R. Bennett Bridge crossing. I am pleased to
report that this program is supported at the administrative level by the
District of Peachland, Westbank First Nation and the Regional District of
Central Okanagan.
RECOMMENDATION: THAT the Committee recommend the Board approve funding a second regional rescue
team on the west side of Okanagan Lake starting in 2015; AND THAT the Committee recommend the Board authorize its signing officers to
enter into a five (5) year agreement with the District of West Kelowna for the
provision of regional rescue services at a 2015 cost of $46,854.32 with annual
increases of 2.5% up to and including 2019.

5. DELEGATIONS
5.1 Okanagan Collaborative Conservation Program (OCCP)
update on the Okanagan Biodiversity Conservation Strategy - Presentation by
Carol Luttmer, OCCP Coordinator
Staff report dated March 3, 2015 outlined the background
of the Okanagan Biodiversity Conservation Strategy (BCS) for the Okanagan
region. The Strategy was completed in 2014 and provided a 'big picture' view of
the status of regional biodiversity and highlighted conservation priorities for the future. The OCCP
has initiated the implementation and monitoring and provided an overview of the
progress towards the BCS vision.
Carol Luttmer provided an overview of the OCCP: • Formed in 2007, partners signed a statement of cooperation - protecting
species at risk and balancing growth with conservation. • Over 35 partners representing academic, all levels of government and
nongovernment organizations. • Primary role is to facilitate collaboration of resources. • Last few years focusing on data collection and mapping. • The Okanagan has 0.8% of the land mass in BC - but has 36% of species at risk. • Guiding principles include: protect representative core habitat areas; protect
habitats characteristic of our region; connect habitat areas; maintain a matrix
of lands outside of core areas and corridors; maintain diversity of ecosystems, species and genetics; look at biodiversity from a regional perspective; share
responsibility; and practice precautionary decision-making. • Strategy outline was reviewed. • Type of map Decision Tool: conservation ranking, relative biodiversity,
wildlife connectivity and land management classes. • Next steps: work with government and non-government agencies and First Nation
to implement the strategy. Main areas to focus on: sharing mapping, education
and outreach, collaboration and partnerships will continue (BC Wildlife
Federation, Okanagan Similkameen Stewardship Society, nongovernment business). • Funding history reviewed: 81% funding comes from grants and foundations.
BAKER/SIEBEN THAT the staff report dated March 3, 2015 and the presentation on the
Biodiversity Conservation Strategy for the Okanagan Region be received for
information.

Staff report dated February 16, 2015 outlined the
requirement to discharge Land Use Contract No. 199 as per the requirements of
the Local Government Act.
The owners of two of the five lots are requesting approval
to discharge the LUC to permit a boundary adjustment intended to increase the
agricultural capacity of the farming operation on the proposed 12.11 ha parcel.
At the time of subdivision the owners will be obliged to satisfy all technical
requirements.
There are no objections from the Agriculture Land
Commission and Agriculture Advisory Commission and the provincial approving
officer will consider proposal under BC Reg 171/2002.

Purpose: To consider issuance of a Temporary Use Permit for a period of
three years to allow the continued operation of a fencing
business on the 10.9 ha (27 acre) property.
Executive Summary: The owner is requesting approval of a second Temporary Use
Permit for a three-year period to allow the continued operation
of a seasonal fencing business in order to accommodate either
closing or selling the business. There has been no objection to
the application from agencies and two letters of support have
been received.
RECOMMENDATION: THAT the Board approve the Temporary Use Permit for Caroline
Rochemont to permit the continued operation of a seasonal
fencing business for three years subject to the following: • There be no increase or expansion to the existing fencing
business footprint; • Hours of operation restricted to 9:00 a.m. to 5:00 p.m.
weekdays and from 9:00 a.m. to 2:30 p.m. on Saturdays; • No buildings, structures, or activity related to the fencing
business (including storage of wood preservative compounds) is
permitted within 15 metres of the high water mark of Joe Rich
Creek; • No construction of, addition to or alteration of a building or
structure; or alteration or clearing of land is to occur within
Development Permit Areas as outlined in the Joe Rich Rural Land
Use Bylaw No. 1195 without prior approval by RDCO; • Should the temporary use cease on the property, all materials
related to the business are to be removed from the property to
the satisfaction of the RDCO; and • The applicant to obtain an access permit from the Ministry of
Transportation and Infrastructure. AND THAT the Temporary Use Permit shall expire in three years
and all uses temporarily authorized by the Permit shall cease
upon expiry of the Permit, unless otherwise authorized.

(TUP-14-02) Central Okanagan East Electoral Area (Electoral Areas - Unweighted
Vote)
Staff report dated February 16, 2015 outlined a temporary
use permit for All Kinds of Fences for a period of three-years to allow the
continued operation of the fencing business adjacent to Highway 33 in the Joe
Rich area. There has been no objections to the application from agencies and two
letters of support have been received.
The question was raised as the business has been in
operation for some time, why is it still considered temporary? At what point in
time does it become permanent? Staff noted this is the first temporary use
permit that has come forward for renewal. Others applicants have either moved to
a new location or rezoned for permanent use. There is no restriction in
legislation to allow consideration of multiple temporary use permits and
therefore no reason why a permit cannot be requested again. It was further noted
that legislation has changed since the first permit was issued. If approved, it
would go from this date for a period of three years. The Chair asked if there was anyone in the gallery who deemed their property
affected by the application. There was no-one.

Purpose: To consider a Front Counter BC referral application requesting approval of a
communication site (30 year term).
Executive Summary: A telecommunication tower is being proposed on the summit of Blue Grouse
Mountain. There are existing telecommunication towers and buildings located at
this site. The Rural Westside Official Community Plan notes that Blue Grouse
Mountain is a visually sensitive area.
RECOMMENDATION: THAT Front Counter referral application for a Communication Site (30 year term)
on the summit of Blue Grouse Mountain (CL-15-01) for SBA Canada, ULC be
conditionally supported subject to the following:
• The Province to consider the visual impact that the
telecommunications tower may have, and that measures be taken to ensure that any
visual impact of the tower is minimized; • Any sensitive environmental features that may be found in tile vicinity of the
proposed development to be avoided; • Best management practices be applied for remote fuel storage and site
security, and that particular attention is given to erosion/rock fall/blasting
during construction and to reestablishment of ground cover and native plants if
removed to reduce the spread of invasive plants; • Installation of the telecommunications tower to be under the supervision of
the appropriate structural and geotechnical engineers; and • Compliance with all conditions and recommendations of applicable Provincial
agencies, First Nations, and other stakeholders. AND THAT the Community Services Department Report dated February 16, 2015, be
forwarded to Front Counter BC's Planning Office for their information and
consideration.

proposed on the summit of Blue Grouse Mountain for a 30-year period. There are
existing telecommunication towers at this site. The applicant proposes to
install a 35-meter tower with the intent to share the site and rent the tower to
carriers to provide wireless, cell phone and internet services.

Fringe Planning Area Agreements The Board rose from In Camera and reported that the following
resolution was
adopted by the Regional Board at its September 29, 2014 In Camera
meeting. Staff
continues to negotiate with municipal partners in a new Part 26
Cost-Sharing Agreement for resolution prior to final budget approval in March
2015.
" THAT the Regional Board authorize its signing officers to
execute, preferably by
Dec. 1, 2014: 1a) Fringe Planning Area (FPA) Operating Agreements with all the
FPA
participants that confirms the existing RDCO operating regime
for fringe area
planning, and that 1b) Transitional Part 26 Cost Sharing Agreements with all FPA
participants based
on the current operating regime to handle FPA matters on an
interim basis be
executed preferably by Dec. 1, 2014.
THAT the Regional Board ratify the existing regime and decision
to execute
Transitional Part 26 Cost Sharing Agreements with all FPA
participants based on
the current operating regime to handle FPA matters on an interim
basis, preferably
by March 16, 2015. THAT following the completion of 1a) and 1b), the Board request
staff to define a
process and obtain position statements from all FPA participants

6.2.1.18 - On Lot 1, Plan KAP12705, District Lot 2198, ODYD the
following
additional use is permitted: 2 seasonal residential dwelling

adjacent to Kilkenny Place, Westside Road and Okanagan Lake.
Central
Okanagan West Electoral Area (Z14/06) (Electoral Areas, Kelowna
and
West Kelowna Fringe Areas) Director Findlater declared a conflict of interest as he owns
property within proximity of the
subject property. Staff report dated January 19, 2015 outlined the zoning
amendment to amend
the permitted uses. Two seasonal dwellings exist on the subject
property, under
the current zoning one single detached house is permitted on the
parcel. The applicant has substantiated historic use of the site. The parcel
is owned by an
incorporated company which consists of two parties. One single detached house is permitted on the parcel; the second
dwelling
currently located on the parcel is considered legally
non-conforming. The history
of the property dates back to the early 1960s.
In discussion, the question was raised whether the Board should
consider first
reading on the bylaw before the applicant agrees to the covenant
limiting the
footprint of each building and questioned what 'seasonal
residential' means. Staff noted that should the current structures be destroyed, and
if a covenant is
not agreed to, the applicant would be allowed to build a larger
building on the
current footprint but that development permits would be
required. The zoning bylaw does not currently have a definition for 'seasonal
residential' but staff were
planning to add a definition in a future amendment of the Zoning
Bylaw No. 871.

Staff report dated January 19, 2015
outlined the application for discharge of Land Use Contract No.
172 for B. & L. Gordon and T. Dore (owners) located at Whelan
Road & Teather Road. A zoning amendment to A1 Agricultural under Zoning Bylaw No. 871 is also included. No further subdivisions
will be permitted as a result of the bylaw amendments. Both
parcels are approximately 5 acres in size. In accord with new
provincial government requirements discharge of all Land Use Contracts in the Province is required. It was noted
that staff will bring forward to the Board as a housekeeping
amendment, applications such as this, where no further
subdivision or development can occur.

Vote) Staff report dated January
5, 2015 outlined a FrontCounter BC referral application to
convert information nature trails over Crown land within the
District of West Kelowna into a designated recreational trail.
The application is to allow upgrades to existing trails, to
manage and maintain key connections including connections to
trails in Rose Valley Regional Park. The recreational trails are located on Crown lands adjacent to the
Park.
FINDLATER/HANSON THAT FrontCounter BC referral application for a License of

Report regarding a FrontCounter BC referral application for
Transportation - Roadway purposes to designate Crown land for a
public road adjacent to Johns Family Nature Conservancy Regional
Park (CL-14-04) Central Okanagan East Electoral Area (All
Directors - Unweighted Vote) Staff
report dated January 5, 2015 outlined a FrontCounter BC referral
application to designate Crown land for a public road. The
application is to provide public road frontage to allow the
adjacent private parcel to be subdivided into two lots under
existing zoning. It appears the majority of required road
frontage for the subdivision can be accommodated via the private
parcel. As there is a staff
recommendation of non-support the Board discussed whether they
should hear from the applicant. FINDLATER/BASRAN THAT the Regional Board agrees to have the applicant address the
Board on his application to FrontCounter BC.
CARRIED Unanimously
Neil Jaud addressed the Board: • Stated he has owned the property in a partnership with another
person for 40 years. Although not subdivided into two lots he
stated the agreement with his partner was he had the upper
portion, his partner had the lower portion. The intent is that
proposed Lot B is his land. • The partner sold off undivided parcels of land in their
section. Now approximately 80 acres is owned by 12 or more
separate owners. Those owners either do not live here or live
'off the grid', and are not interested in upgrades (subdivision,
roads) to the property, and are not interested in any financial
upgrades to the property. • The application would provide access to what Mr. Jaud's
believes is his section of land so he can move forward with
subdivision plans. • Surveys, environment assessments and road design have been
completed on his section of the property. Mr. Jaud is now
attempting to have legal title for what he considers is his
section of the property. • Mr. Jaud cannot get all the other owners to agree to a road on
the private property but does have support for this application
by some of the other owners. • MOTI will not entertain extending Chute Lake Road to this
property. • The applicant believes this is the only avenue to access his
portion of the land. • He owns 50% of entire parcel. If subdivided he would take 100%
of proposed lot B. Discussion: - Staff prepared to work with the applicant and the Province. - The reason for staff's non-support of the referral is due to
environmental issues. - Multiple owners of properties is this normal? Staff noted that
yes this does occur throughout this and other rural areas in the
region. Many were purchased 30-40 years ago. - One option for all the owners is to consider a panhandle lot.
Moving the road on the private property. There are environmental
issues in some locations (Lebanon Creek area). - Are there any different environmental impacts for either
proposal-Crown land versus the privately held land? EAC felt
there was more sensitivity on the Crown land. - Placing a road outside the private property is very uncommon. - Standard of road is a rural standard. - Cost of road would be borne by applicant. - This situation is very complex for the applicant. - There is a lot of history on this property starting during the
Okanagan Mountain Park fire in 2003 when it was determined there
were people living 'off the grid' in this area. - Staff looking at this as a simple subdivision. The number of
owners does not come into play in considering a subdivision.
RDCO does not approve subdivision. The Provincial Approving
Officer is the authority to approve subdivision. - Staff is working with the applicant on any environmental
permitting required for the subdivision. - Staff recommendation may be the right way to go but on
compassionate grounds and where the property is located (off the
grid) and that it is an impossible task to move forward for the
applicant, consideration should be given to support the
applicant. - Whether the road is on private or Crown land the impact to the
environment is the same. FINDLATER/BASRAN THAT FrontCounter BC referral application for N. & T. Jaud
(applicant) for Transportation - Roadway purposes to designate
Crown land for a public road adjacent to Johns Family Nature
Conservancy Regional Park (CL-14-04) to designate a 1.21 ha
portion of Crown land for a public road be supported; AND FURTHER THAT the Community Services Department report dated
January 5, 2015 be forwarded to FrontCounter BC for their
information and consideration. CARRIED Unanimously

Report regarding a FrontCounter BC referral application to
convert a current License of Occupation to a permanent easement
to access private property in the vicinity of June Springs Road
(CL-14-05) Central Okanagan East Electoral Area (All Directors -
Unweighted Vote) Staff report
dated January 6, 2015 outlined a FrontCounter BC referral
application to convert a current License of Occupation to a
permanent easement for access to a private property. The
applicant currently has a License of Occupation with the
Province (expires Aug.2021) over the subject Crown land for the
purpose of road access from June Springs Road to the land-locked
property. It is not anticipated any new land disturbance would
be required and conversion to an easement would provide the
applicant with permanent access rights to the existing private
parcel of land. This is the only access to the private property
which has the Myra Canyon Adventure Park located on the
property. HANSON/OPHUS THAT FrontCounter BC referral application for R. Schoenerr
(applicant) to convert a current License of Occupation to a
permanent easement to access private property in the vicinity of
June Springs Road (CL-14-05) be supported subject to the
easement encapsulating the existing developed access; AND FURTHER THAT the Community Services Department report dated
January 6, 2015 be forwarded to FrontCounter BC for their
information and consideration. CARRIED Unanimously

Report regarding a FrontCounter BC referral application for
License of Occupation (30-year plus term) for a recreational
trail on Crown Land in the vicinity of Pincushion Mountain
(CL-14-06) Central Okanagan West Electoral Area (All Directors -
Unweighted Vote) Staff report
dated January 6, 2015 outlined a referral application from
FrontCounter BC to permit the Peachland Outdoors Club to
construct, rehabilitate or maintain a trail for a 30-year term.
The proposed trail is located on Crown land adjacent to the
District of Peachland. The
question was raised who will manage or 'police' the trails? The
Peachland Outdoors Club is the applicant. Staff noted these are
not regional park trails.
RDCO bylaws do not apply to Crown
land and RDCO will not oversee the management
plan. The Province determines when trails need to be closed for
fire hazard, etc.
BAKER/BASRAN THAT FrontCounter BC referral application for License of
Occupation (30-year plus term) for a recreational trail on Crown
Land in the Vicinity of Pincushion Mountain (CL14- 06) for the
Peachland Outdoors Club to allow construction, rehabilitation or
maintenance of a trail for a 30-year term be supported subject
to the following conditions: • Trail to be limited exclusively to non-motorized use; • Trail signage to be installed to identify trail directions and
locations relative to Crown, private and RDCO owned lands, and
to identify non-motorized use; and • Completion of an environmental assessment & management plan
for review by RDCO that identifies best management practices and
mitigation to ensure that environmental impacts from
construction, maintenance, and use of new and existing trails are minimized. The management plan should also
address access to the trail heads, parking, signage, waste
management, safety and fire hazards; • The District of Peachland's conditions outlined in their
Council resolution. AND FURTHER THAT the Community Services Department report of
January 6, 2015 be forwarded to FrontCounter BC for their
information and consideration. CARRIED Unanimously
