In case you ever encounter dog control wanting to seize your dog, under Section
49 of the Community Charter, they first have to have a warrant to seize from
your personal residence. Section 49 of the Community Charter is what the
Dog Control Officers use frequently outside the Bylaw. It gives them “Absolute
Powers”.

Ombudsperson releases guide for fair bylaw enforcement
Victoria – B.C. Ombudsperson Jay Chalke has released a
guide today aimed at improving the fairness of local
government bylaw enforcement programs.
“Bylaw Enforcement: Best Practices Guide for Local
Governments is to help municipal officials review and
revise bylaw enforcement programs to support fair
treatment, save money and inspire public confidence,”
says Ombudsperson Chalke. “Whether it’s animal control,
noise complaints, unsightly premises, building permits –
or any other area covered under a bylaw – this report
provides a path to fairness.”
Bylaw enforcement processes addressed in the new guide
include the role of council, complaint handling,
investigations, enforcement decisions and appeals. Five
best practices checklists are also included for quick
reference.
“Too often bylaw enforcement can result in unnecessary
conflict, unfairness and frustration,” says Chalke. “Our
investigations of local governments have identified root
causes to these problems that are recurring, preventable
– or both.”
Examples of Ombudsperson bylaw enforcement
investigations are found in the guide. Local governments
make up about eight per cent of complaints made to the
Office of the Ombudsperson, the independent office with
oversight over administrative fairness of B.C. public
authorities – including each municipality, regional
district, improvement district and the Islands Trust.
“Bylaw Enforcement is a practical tool each local
government in B.C. can use to best apply the principles
of administrative fairness,” says Chalke.
Each local government in B.C. will receive a copy of
Bylaw Enforcement: Best Practices Guide for Local
Governments. The guide can be obtained free of charge at
www.bcombudsperson.ca
Since 1979, the Office of the Ombudsperson has had a
statutory mandate from the provincial legislature to
uphold fair and reasonable conduct by provincial public
authorities. In addition to investigating individual
complaints, the Ombudsperson also publishes systemic
investigations and recommendations for changes that
address administrative unfairness and improve public
administration in B.C.

7.2 Systematic Review of Current Board Policies - Request
for Direction (All Directors - Unweighted Vote)
Chief Administrative Officer report dated January 18, 2016
outlined the requirement for review of RDCO policies to ensure they are
relevant, and amend where necessary. This review will be conducted over the next
18-24 months.
In discussion it was suggested to separate Administrative
policies from the Board policies. Is it necessary to review both policies and
bylaws at the same time, and are there staff resources to complete these
projects. The Administrator noted that this work needs to be done and believes
many of the policies will not take long to review.
FINDLATER/GRAY
THAT the Board direct staff to systematically bring forward all Regional Board
policies for review over the next 18 to 24 months.

calls seven days a week, beginning this weekend.
People with a bylaw issue can phone 778-797-8810 seven
days a week from 8:30 a.m. to 4:30 p.m. Calls made after
hours will be forwarded to an automated messaging system
for followup the next business day.

7.1 and 7.2 Unsightly Premises Noise Control Service Review
Purpose: To present a Service Review Report for the RCMP Victim Services Program
and confirm if there are any additional issues the Board wishes to have
addressed.
Executive Summary:
On January 16, 2014 the Board approved a Service Establishment Bylaw Review
Schedule that has every service the Regional District provides reviewed every
five (5) years. In 2015 the RCMP Victim Services Program is one of ten services
that are subject to review. In preparing this Service Review Report staff
reviewed the program's mandate, goals, and activities to confirm we are
achieving the Board's objective of providing efficient, cost effective services.
The primary objective of this program is to provide bylaw enforcement services
for unsightly premises and noise control complaints in the electoral areas only:
Central Okanagan East and Central Okanagan West. Enforcement is complaint
driven. The Regional District has one fulltime employee-the Chief Bylaw
Enforcement Officer-that is responsible for enforcing general bylaw complaints.
In the last two years, a casual bylaw enforcement officer has assisted with
education and enforcement, as required.
Noise Control: In 2014, two complaints were received, no tickets were
issues. In 2015, no complaints have been received to date. Staff receives a very
limited number of calls that require education but no enforcement.
Unsightly Premises: In 2014, 16 complaints were received, 1 enforcement
order given and one ticket issued. In 2015, 9 complaints were received, 4
enforcement orders given, and no tickets have been issued to date.
RECOMMENDATION:
THAT the Governance and Services Committee recommend the Board continue to
support the current service delivery model for Unsightly Premises and Noise
Control Services.

7.9 Business Licensing Program Service Review
Purpose: To present a Service Review Report for the Business Licensing Program
and confirm if there are any additional issues the Board wishes to have
addressed.
Executive Summary:
On January 16, 2014 the Board approved a Service Establishment Bylaw Review
Schedule that has every service the Regional District provides reviewed every
five (5) years. In 2015 the Business Licensing Program is one of ten services
that are subject to review. In preparing this Service Review Report staff
reviewed the program's mandate, goals, and activities to confirm we are
achieving the Board's objective of providing efficient, cost effective services.
The primary objective of this program is the administration of the Central
Okanagan Business Licensing and Regulations Bylaw and the Inter-Community
Business License Bylaw in order to ensure businesses comply' with local zoning
and building regulations and to minimize the impacts of incompatible adjacency
issues. This program currently administers approximately 220 business licenses,
of which, more than one third currently participate in the InterCommunity
Licence program and the Province's Mobile Business Registry.
This service review concludes that this program is meeting its current mandate
and achieving its goals. At this time staff would be pleased to answer any
questions the Board may have regarding this report and ask the Board if it has
any other issues they would like followed up on in this review.
RECOMMENDATION:
THAT the Governance and Services Committee recommend the Board continue to
support the current service delivery model for the Business Licensing Program.

7. 2015 Board Approved Service Reviews
In January 2014, the Regional Board approved a schedule of
service reviews. The following ten services were reviewed in 2015. This provided
a good opportunity to review the services to highlight any concerns and
potential improvements.
7.1 Unsightly Premises Service (Central Okanagan East &
West Electoral Areas)
The Unsightly Premises & Visual Nuisance Bylaw No. 770
applies to the two electoral areas and is complaint driven. In 2015, nine
complaints were received, four enforcement orders and no tickets. Issues are
investigated with limited resources.
Director Carson noted he wishes to consider withdrawing from the service. It was
noted there is a process to be followed to withdraw from a service. Further
discussion is to occur with the Administrator.
It was noted that staff resources at the RDCO would remain
the same as there is only one enforcement officer in the position for all bylaw
enforcement in the RDCO.
OPHUS/DEHART
THAT the Governance and Services Committee recommend the Board continue to
support the current service delivery model for Unsightly Premises Service.

7.2 Noise Control Service (Central Okanagan East & West
Electoral Areas)
The Noise Control Bylaw No. 403 applies to the two
electoral areas and is complaint driven. In 2015, no complaints were received.
In 2011, a Consent Order agreement was reached with the Kelowna Dirt Bike Club
and is binding as long as
the RDCO approves, on application, up to four special events permit per year.
Director Carson noted he wishes to consider withdrawing
from the service. It was noted there is a process to be followed to withdraw
from a service. Further discussion is to occur with the Administrator.
It was noted that staff resources at the RDCO would remain
the same as there is only one enforcement officer in the position.
BAKER/STACK
THAT the Governance and Services Committee recommend the Board continue to
support the current service delivery model for Noise Control Service.

SUBJECT: Bylaw Enforcement Officer Appointment
Purpose: Board appointment is required to enforce and administer bylaws of the
Regional District of Central Okanagan.
Executive Summary:
The Chief Bylaw Enforcement Officer is currently on leave, and there is a need
to have a bylaw enforcement officer appointed to
manage
bylaw enforcement issues,
if and when required, within the electoral areas.
Kim Mussenden has the
experience to fulfil this role as required.
RECOMMENDATION:
THAT Kim Mussenden be appointed as a Bylaw Enforcement Officer for the Regional
District of Central Okanagan.

Kim Mussenden was Administrative Assistant as well as Bylaw
Enforcement Officer for the Weed and Insect Bylaws, now she is managing bylaw
enforcement issues and taking Rhoda Muellers job while she is away. Wonder
if this includes dogs, because it does not stipulate if it does include dogs or
not. Rhoda Mueller was manager of dogs too. Do we have two managers
of Dog Control? We would hope not.

105 - Enforcement of Noise Bylaws
Four Special Events permits were approved for Kelowna Dirt Bike Club race
activities at its facility adjacent to the Bear Creek Forest Service Rd. Noise
regulations were waived for the permitted events.
115 - Enforcement of Noxious Insect Control Bylaws
The Regional Board adopted amendment Bylaw No. 1334 on October 10, 2013,
removing the District of West Kelowna from the service area boundaries effective
December 31,2013. To June 30, 2014, 100% of the complaints originated in the
City of Kelowna. Of the eleven complaints, nine were for the Pine Beetle. RDCO
has received notification of a $13,000 grant approval from the Ministry of
Forests Lands and Natural Resources. This funding will be directed into
education tools and opportunities when the seasonal bylaw commences in April.
116 - Enforcement of Noxious Weed Control Bylaw
Amendment Bylaw Notice Enforcement No. 1346 adopted February 24,2014,
implemented new fines for Noxious Weed Control. Invasive Plant education,
utilizing the $13,000 grant funding from the Ministry of Forests Lands & Natural
Resources is ongoing in 2014 and is integrated with the bylaw program.
The Regional Board adopted amendment Bylaw No. 1333 on October 10, 2013,
removing the District of West Kelowna from the service area boundaries effective
December 31, 2013. Calls pertaining to the District of West Kelowna are logged
as complaints and recorded as "No Inspection Required".
To June 30, 2014, a total of 368 Complaints, 314 Property inspections and 205
Enforcement Orders occurred. To June 30, 2013, Complaints totaled 230, Property
inspections numbered 428 and there were 214 Enforcement Orders given. Five
percent of complaints and property inspections and 7% of enforcement orders
given occurred in the Electoral Areas. The Electoral Areas consist of 3% of the
population.

Purpose:
To provide the Regional Board with information and an update on
Bill 17 -
Miscellaneous Statutes Amendment Act.
Executive Summary:
Bill 17 - Miscellaneous Statutes Amendment Act includes a number of amendments.
Specific amendments which will affect the Regional District of Central Okanagan
include
the intent to
terminate all land use contacts (LUC) in the province by June 30, 2024,
in addition to streamlining the bylaw approval process by removing unnecessary
ministerial approval.
The intent of this component of Bill 17 is to streamline
the approval process for all regional districts adopting OCP's, zoning or
subdivision servicing bylaws, issuing temporary use permits and amending LUC's
by exempting all regional districts from ministerial
approval for these types of bylaws.

Taxation (Rural Area) Act - The proposed amendments to
the act will provide the province authority to issue tax
notices to a single representative, rather than each owner, on
properties that have more than a prescribed number of owners. The changes will
help streamline processes, avoid taxpayer confusion and duplicate payments, and
they will bring B.C.'s legislation in line with how other jurisdictions
administer property taxes.

Local Government Act, Community Charter and Vancouver
Charter - The proposed legislative amendments will support economic development
by cutting red tape that can delay building projects
and add costs for developers and landowners.
Amendments to the Local Government Act, Community Charter and Vancouver Charter
will remove unnecessary ministerial approvals for land use planning and
development decisions, allow modern land use policies and practices to replace
outdated land use contracts and protect developers from increases in development
cost charges.

Staff report dated May 20,2014 outlined amendments to
Bill 17 that is currently receiving readings by the Province and which include
the intent to terminate all Land Use Contracts in the province by June 30, 2024,
in addition to streamlining the bylaw approval process for removing unnecessary
ministerial approval processes. It would be staff's intent to initiate bylaws
well in advance of the termination date. A plan will be brought forward to the
Board likely in 2015. A question was raised regarding whether there will be an
impact on development cost charges associated with terminating contracts. Staff
will address in their plan to the Board.
Staff noted it has always been RDCO's intent to work
with land owners to bring forward amendments that fit within their current
buildings--this will be dealt with like any other bylaw amendments and
legislative process. There is 9 land use contracts within the electoral areas,
some of which will be quite complex.

February 24, 2014 Highlights of the Regional District of Central Okanagan Regular Board Meeting
Responsible Dog Ownership Bylaw Adopted
The Regional Board has adopted the new Responsible Dog Ownership Bylaw No. 1343.
In addition to emails and telephone inquiries about the bylaw, more than 900
responses were received to an online questionnaire and approximately 35 people
attended an advertised Information Open House. After receiving this public input
and in order to help clarify some areas of the bylaw, several amendments were
made prior to final Board consideration. Among the changes to the bylaw: a leash
is defined as being no more than two meters in length; owners of dogs newly
declared dangerous will be required to post signs advising a dangerous dog is on
the property and increased fines for owners of dogs that are found at large, off
leash in an area not designated for off-leash activity and failing to pick up
and dispose of waste. The Board has maintained the two dog maximum and requested
a further report regarding the proposal to allow a three dog maximum.

The bylaw does not ban the sale of retractable
leashes-owners would be required while in a public place to lock their
leash at 2 meters or less. (page 2)
In addition, one impression raised on social media websites and
letter writers: that the Responsible Dog Ownership Bylaw is giving animal
control officers new, broader powers to enter private property. The bylaw (Part
3 - Right of Inspection), is clearly publicizing, the Provincial authority that
has been provided to any bylaw enforcement or animal control officer, through
sections of the Local Government Act and Community Charter. Section 268 of the
Local Government Act (Inspections to determine whether bylaws are being
followed) states: if a Board has authority to regulate, prohibit, and impose
requirements in relation to a malter, the board may, by
bylaw, authorize officers, employees, and agents of the regional district to
enter,
at all reasonable times, on any property to inspect and determine whether all
regulations, prohibitions and requirements are being met.
All Part 3 of the Responsible Dog Ownership Bylaw is doing, is publically
stating the authority under which animal control officers (and bylaw officers in
general) are able to enforce the bylaw. In addition,
Section 49 of the Community Charter sets out that an animal control officer may
obtain a warrant, search a place and
seize a dangerous dog. (page 4)
The bylaw will hopefully result in a reduction in the subsidy
provided by general taxpayers throughout the Central Okanagan. (page 5)

28. An Owner may cause or permit his or her dog to be At Large in a designated
off-leash park or area provided that the Owner complies with the following
requirements:
e) The dog is healthy and has
up-to-date vaccinations as defined by

Dog Control Services
8.1 Regional District of Central Okanagan Responsible Dog Ownership Bylaw No,
1343, 3rd reading and Adoption (All Directors - Unweighted Vote)
Staff report dated February 17, 2014 outlined the public consultation phase
of the Dog Bylaw. Staff provided a review of the public input received following
2nd reading of the bylaw: on-line questionnaire (909 responses); emails/letters;
phone calls; approximately 35 attended an open house (posted online the panels
which were used at the open house); and spoke with individuals who have come
into the office to renew their dog license. Incorrect social media efforts were
corrected by a press release.
Subsequent to public input staff recommended amendments to the bylaw and
reviewed the amendments with the Board.
Discussion:
- It has been a long process with the end result being a well-written bylaw.
- Concern was raised whether 3 dogs are too many in an urban area. The question
was raised whether the regulation could be limited to 3 per property.
As the bylaw is written, a house with a suite or duplex, four-plex could have 3
dogs per unit. It was noted that apartments, condos, landlords, etc. are allowed
to regulate the number of dogs and the size of dog on their property.
Is it possible to limit the number to three per property? Staff will need
further legal advice to determine if this is possible. Staff noted that if a dog
owner is responsible there should be no enforcement issue. The premise of the
bylaw is responsible dog ownership.
- District of West Kelowna and the RDCO's current zoning bylaw limits the number
of dogs in a hobby kennel from 3 to 20. A zoning bylaw amendment would be
required to accommodate a 3 dog maximum (hobby kennel 4-20 dogs).
- 2 meter leash regulation--the intent is to
keep the dog under control. Other jurisdictions have similar regulations as
well.
- Noise enforcement is complaint driven as
it is in the current bylaw. (What is RDCO going to do,
ignore a barking dog when they notice its barking in violation, if nobody makes
a complaint?)

THAT Regional District of Central Okanagan Responsible Dog Ownership Bylaw No.
1343,2014 be given 3rd reading and adopted, as amended:
Amendment #1:
Section 8. Upon request by an Animal Control Officer, an Owner in contravention
of any provision of this Bylaw shall stop and provide the Animal Control Officer
with identification giving his or her full name and current address, and the
licensing information of the dog.
Amendment #2:
Definition
"Guide/Service Dog means any dog with a valid Guide
Animal Certificate under the Guide Animal Act."
Amendment #3:
Section 15. Any dog registered under the Guide Animal Act and resides with a
person for whom the dog provides care and assistance will not be considered in
the 3-dog limit of section 14 of this Bylaw.
(1) An Owner of a dog registered under the Guide Animal Act or that is
registered in the Guide/Service Dog in Training Program; or used by the Royal
Canadian Mounted Police; shall obtain a license but not be charged licensing
fees provided that the appropriate registration is presented to the Animal
Control Officer."

showing the license issued to an Owner of a dog by the Regional District.
Section 12. An Owner shall ensure that the dog tag is attached to the collar or

of dogs permitted for kennels in the District of West Kelowna and RDCO's zoning

December 9, 2013 Highlights of the Regional District of Central Okanagan Regular Board Meeting
Dog Service Model Implementation Update
The Regional Board has received an update on the implementation of
recommendations stemming from the 2012 Dog Service Review. Consultant Allan
Neilson says many proactive measures have been taken during 2013 to encourage,
support and reward responsible dog ownership. These efforts include launching of
the ‘My Dog Matters’ rewards program, licensing of an additional 3,600 dogs
through the October Free License Amnesty and introduction of online license
purchasing starting January 1st, 2014. Plans for 2014 include consideration of a
new Responsible Dog Ownership Bylaw and various educational and awareness
efforts to support responsible dog owners.
No Dog License Fine Increasing Jan. 1st 2014
The Regional Board has adopted bylaw changes that will see a substantial
increase in the fine for the owner of an unlicensed dog. Starting January 1st,
any unlicensed dog will be subject to a $300 fine. The current fine is $100. The
increased fine brings the Regional District in line with other local governments
that are holding dog owners accountable for ensuring they have a valid dog
license, which is required in the Dog Impounding and Regulation Bylaw.

Executive Summary:
John Hailstones has been employed as a Building and Business License Inspector
with the Community Services department since October 30,2012. Non-compliance
issues within the Building and Business License program are a regular
occurrence. John Hailstone's Board appointment will provide for additional tools
and depth within his principal accountabilities and within other bylaw
enforcement contingencies.
RECOMMENDATION:
THAT John Hailstones be appointed as a Bylaw Enforcement Officer for all
Regional District of Central Okanagan bylaws while employed with the Regional

Amendment Bylaw No. 1333, 1st, 2nd and 3rd readings (All Directors - Unweighted

Staff report dated October 7, 2013 outlined the requirement to amend the
service establishment bylaw for the withdrawal of the District of West Kelowna
from the regional services of Weed control effective December 31, 2013. The
Board at its May 9, 2013 endorsed the withdrawal of West Kelowna from the
service and identified the share in the reserve balance at
the end of 2013.
It was noted that the District of Lake Country's raised the issue regarding
if other partners wish to leave the service how would that occur. It was noted
that this bylaw amendment is regarding the District of West Kelowna's
request and that if other partners wish to consider leaving a service they would
need to provide official notification to the RDCO and the Board would consider
the request at that time.
The amendment bylaw reflects direction given to staff from the Board.
Brian Reardon will address issues raised by Lake Country directly with Lake
Country. The service remains the same for the other partners--the financial
impact is negligible.

OkanaganLakeBC.ca says: Isn't it strange that
RDCO does not enforce its dog bylaw between the hours of 5pm - 8am and won't let
the RCMP enforce its dog bylaw during those hours, but will let the RCMP enforce
the Parks bylaw which includes dogs in parks, and all these other bylaws shown
below, but not the dog bylaw. We are sure it is this way due to RDCO not
wanting to enforce its barking dog bylaw at Valley of the Sun, and most likely
chose this route on purpose so that the person complaining about barking dogs
overnight at Valley of the Sun has to live with being tired all the time and has
to live with Lichen Planus flareups which may be caused by stress. RDCO doesn't
like this person much because the person complains to RDCO about the poor
neglected dogs at Valley of the Sun. RDCO is the meanest and nastiest in
OkanaganLakeBC.ca's opinion. We urge you to complain about RDCO not
permitting the RCMP to enforce its dog bylaw overnight when RDCO Dog Control is
not available. Please phone RDCO Chief Administrative Officer Brian
Reardon at (250) 763-4918 and let him know this is not acceptable!!!

7. UNFINISHED BUSINESS
7.1 Bylaw Notice Dispute Adjudication System (All Directors - Unweighted Vote)
Staff report dated November 16th outlined that further to Board discussion on
the Regional District's participation in the bylaw notice dispute adjudication
system, which replaces the Provincial Court ticketing system as a venue for
resolving
disputes pertaining to minor bylaw breaches, staff have confirmed that it will
be possible for the Regional District to participate in this system for minor
bylaw infractions including: parks, zoning, noise, animal, unsightly premises,
fire and
water infractions and minor dog control tickets. This system does not replace
any action under the Community Charter for dangerous dog applications.
New partners to the system are invited in September of each year, and as the
RDCO was contemplating the move to join the SIBNDA group supported a resolution
for the RDCO to join subject to Regional Board approval. The process for final
approval and implementation will take approximately 3 months to complete.
FINDLATER/EDGSON
THAT the Regional District of Central Okanagan agrees to establish and partner
in the Bylaw Dispute Adjudication System with the Southern Interior Bylaw Notice
Dispute Adjudication Registry Group.;
AND FURTHER THAT the Regional District forward a copy of the resolution
indicating its intent to establish a bylaw dispute resolution system to the
Court Services Branch, Ministry of Justice.

11. DIRECTORS ITEMS (requiring Board action)
11.1 Use of Recreational Areas - Bush Parties
In light of a bush party which occurred in the Peachland area over the
weekend, and the resulting trash left behind, the question was raised whether
there is some way to appropriately deal with or regulate these gatherings. In
some cases, the recreational area is being destroyed by trash left behind, trees
cut down, litter thrown into lakes, etc. It was noted that these types of
gatherings can't be regulated and have been going on forever. They normally
occur on Crown lands or private properties. Local governments have no authority
when it occurs on Crown lands. The RCMP, Ministry of Forests, Lands and Natural
Resources, Ministry of Environment and conservation officers do attend and
enforce rules and safety in recreational areas but it's impossible to cover
everywhere.
Discussion ensued:
• This topic has been discussed at past Land and Resources Management Plan (LRMP)
meetings. LRMPs have been completed around the province and have identified
protected areas, environmental, recreational zones.
LRMPs have also had a role in identifying where government policies need to be
revised. Need to work collaboratively with provincial agencies.
• Illegal camping, destruction of the environment, littering and fires are
important issues. People have access to forestry roads making access easier, and
for some people they seem not to care about the destruction left behind.
• No one is keeping an eye on the Crown lands as in the past - there are few to
no resource managers any longer.
• There is no capacity for more enforcement - one conservation officer in large
area.
• Conservation officers have met with Lake Country and they note there are not
enough camp sites so people are just camping in the forests. They can't do
anything about people camping on Crown lands if they are following the
provincial rules and regulations.
• More education is needed regarding destruction of the environment and
responsible use of Crown lands.
• This issue has to be managed by the Province-but there may be ways local
government can work with the Province?

parties, illegal camping on Crown lands.

RECOMMENDATION:
That Buckerfields in West Kelowna and Animal House Pets & Supplies in Kelowna,
be appointed as agents of the Regional District of Central Okanagan for the
purpose of selling dog licenses.
BACKGROUND:
Board Appointment for authorization to issue Dog licenses is required by Dog
Control Bylaw No. 366. There are a total of 28 locations throughout the Central
Okanagan where dog owners can purchase dog licenses. Their purpose is to provide
convenient locations for dog owners to purchase their dog licenses.
Buckerfields is located at 2565 Main Street, Highway 97 South, West Kelowna, V4T
2B4, 250768- 8870. Animal House Pets & Supplies is located at 106-125 Hwy 33
East, Kelowna, BC V1X 2A1, 250-765-7664.

department. She was previously employed in this position between 2005 & 2007 but
was not appointed during this time.

2.3 2012 Budget Review
Marilyn Rilkoff began a review of the 2012 budget. The question was raised
regarding FTE's (full-time equivalents) and whether the cost is applied to the
department they report to or the service. FTE costs are allocated to individual
services. If you participate in a service you pay a portion of FTE.
Dog Control
-Increase to tax requisition due to cost of service review
-Staff noted that the service review will address revenues increases. With
respect to boarding dogs - legal counsel has been asked to provide a consent
order (indemnification, euthanize if dog is at large or attacks) where dogs can
be released to the owner while waiting court trail.
-Service review - achieve what the Board asked it to do!
Come out
with a model for cost recovery and model for service delivery with objective to
reduce tax requisitions. Community money is it being efficiently
used on dogs - many organizations doing the same thing.

or yelping sporadically or erratically for a cumulative duration of

period which sounds are repeated again within 72 hours.
21.2 No person being the owner or occupant of any private premises
shall permit, allow or suffer the noise of barking, yelping or
howling sounds from a dog(s) to be caused or made at the private
premises owned or occupied by that person, in a manner that can
easily be heard or otherwise perceived by an individual who is not
at the same private premises. |

Lake Country seeks bylaw compliance

Bylaw infractions are a common occurrence in any local government
that enacts regulatory bylaws.
This was highlighted last week when a property owner in the District
of Lake Country, believing her neighbour to be contravening an
unsightly property and visual nuisance bylaw, approached the media
in an attempt to get the property owner to take action and clean up
his property.
Hazel Christy, Director of Corporate Services for the District, says
that local governments have used three main strategies to deal with
the problem:
•Seek voluntary compliance or
•Issue an offence notice for infractions, seeking voluntary payment
of a prescribed fine or
•Initiate formal court proceedings by issuing a Municipal Ticket
Information (MTI) or a Summons.
"Voluntary compliance is obviously our preferred way of dealing with
bylaw infractions. As is the case with many other small
municipalities, we have to prioritize how we spend taxpayers funds,"
says Christy.
"Safety, health and the environment are our first priorities and we
have always taken the required action when there has been any risk
to our citizens even if it has meant costly legal action," she said.
With reference to the specific case in Lake Country, Christy says,
"Although the discarded material is unsightly, District staff
inspected the property and found that it poses neither safety,
health nor
environmental risks."
"Instead of taking costly legal action, we have been in regular
contact with the owner, who has committed to voluntary cleanup all
discarded material in order to comply with the District's
Prohibition of Unsightly Premises Bylaw No. 433.
She adds the introduction of a new Bylaw Adjudication system will
help municipalities in enforcing bylaws.
"Municipalities in the Okanagan have worked closely to get this
implemented hopefully in the Fall of 2010. The goal of the new
adjudication model is to create simple, fair and cost effective
systems for dealing with minor bylaw infractions."
Mayor James Baker, Council and District staff will be engaging with
the community to address issues related to bylaws and their
enforcement along with other community issues during Front Porch
Meetings in the Fall of 2010. |

RECOMMENDATION:
That the Regional Board not participate in the Okanagan Valley Bylaw Dispute
Adjudication Program and that staff investigate the Okanagan Valley Program for
actual costs and results in the year after it's implementation.
BACKGROUND:
On November 12, 2009, staff reported on the Okanagan Valley Bylaw Adjudication
Program with a recommendation not to participate in the program as it is
intended as an alternative approach for processing and resolving minor bylaw
infractions.
The Board requested that the Regional District of Central Okanagan defer the
decision to not participate in the Okanagan Valley Bylaw Dispute Adjudication
Program; and that staff attend the information meetings, reconfirm costs for
setup and participation in the program and confirm whether it makes sense for
the Regional District to participate in the program.
The Regional Board raised the question again at the March 11, 2010 meeting for a
report back on the bylaw adjudication system.
Staff participated in a meeting by the Okanagan Valley Adjudication Group on
December 4, 2009 and took opportunity to address the group about why the RDCO
was not participating at this time. Input from the group was that their Councils
were requesting higher fine amounts and participants confirmed that the program
was intended for minor issues such as parking
violations.
Since this meeting, the Okanagan Valley Bylaw Adjudication Group is proceeding
with an implementation schedule of September 2010.
In their attempt to
keep the process moving they have frozen the participants to the existing
partners and any additional organizations will have to wait a year to be
included.
The Group has estimated annual costs of $50,000 which is shared by the group
based on population for each area. Kelowna will administer the registry and the
adjudication hearing process. The Group estimated the Regional District of
Central Okanagan's portion of the shared costs at $5,300. Each participant is
responsible for their own setup for screening and
administration leading to adjudication hearings. The Adjudication System has
been adopted in other BC municipalities, and has proven to be successful as an
alternative approach for processing and resolving minor bylaw infractions.
The Regional District of Central Okanagan does not have a traffic bylaw and
tickets are issued primarily under the dog control function.
Two tickets were issued for all other bylaws in
2009.
The weed program and unsightly premises bylaws are
direct enforcement programs where work is carried out and
no tickets are issued.
Because of the complexities in dog control services, these tickets are not
suitable for the adjudication program. Most tickets involve witnesses and
exhibits. Costs of the program administration and adjudication process are
additional to the budgets set for 2010.
As service levels within the bylaw department evolve, the adjudication program
may become a required tool. An example of this might be issuing more tickets for
no dog licenses as public compliance drops off due to increased late penalties.
Current limits to staff resource time for setting up the program and ongoing
administration and housekeeping would be a challenge at
this time.
Staff recommend that the Regional Board not participate in the Okanagan Valley
Bylaw Dispute Adjudication Program. However, the Regional Board may decide to
participate in the Program without expectations until such time that applicable
or appropriate cases dictate the suitability to the program. Additional costs
would be easier to estimate for the setup, screening and administration after
the Group's first year's activities.

6. Development Services
6.1 Bylaw Dispute Adjudication Program (follow-up report)
Staff report dated March 30, 2010 outlined the background
information on the bylaw adjudication program. Since late 2009
staff have further participated in meetings by the Okanagan
Valley Adjudication Group and took the opportunity to explain
why participation of the Regional District is not appropriate in
that the program is intended for minor issues such as parking
violations. The Regional District does not have a traffic bylaw
and tickets are primarily issues under the dog control function.
Due to the complexities in dog control service, these tickets
are not suitable for the adjudication program.
Staff highlighted the dog control policies with regards to
ticketing. The public has the option to dispute a ticket, and if
they do, the court system is the only option.
Staff are reviewing the compliance issues and actions.
